UAB “Greitoji žirafa” rules for purchasing programs for veterinary services
1. General provisions
1.1. These rules for the purchase and sale of veterinary service programs for dogs and cats (hereinafter – the “Service Programs”) (hereinafter – the “Rules”) are a legally binding document that establishes UAB “Greitoji žirafa” (hereinafter – the “Seller”) and the buyer of the service programs ( hereinafter – the “Buyer”) mutual rights, duties and responsibilities, when the Buyer purchases service programs in the electronic store greitojizirafa.lt (hereinafter – the “e.store”).
1.2. The Rules, together with the order submitted by the Buyer in the e-store, become the contract of purchase and sale of the Service program concluded by the Buyer and the Seller and a legal document binding on both parties.
2. Information about the Seller
2.1. The seller is UAB “Greitoji žirafa”, legal entity code – 301691709, registration address – Žemynos st. 2b, Vilnius. Data about the Seller are collected and stored in the Register of Legal Entities, the registry manager is the State Register Center.
2.2. More information about the Seller is available on the website www.greitojizirafa.lt. 2.3. The seller’s contact information is available in the “Contacts” section of the website.
3. Service programs
3.1. Service programs are veterinary services provided by the Seller, which the Seller offers to the Buyer and which the Seller publishes on its website www.greitojizirafa.lt, by ordering which the Buyer acquires the right to use the services specified in the specific Service program, provided at the veterinary clinic at Žemynos st. 2b, Vilnius, 12 months from the purchase of the Service program.
3.2. Information about the Service program ordered by the Buyer, its conditions and the services provided to the Buyer are stored in the Seller’s internal database.
3.3. The seller reserves the right to change information about the Service programs and conditions at its discretion, by posting the changes on the website www.greitojizirafa.lt, including, but not limited to, the right to change the composition, descriptions, prices and other essential conditions of the Service programs. The Buyer is aware and agrees that information about changes related to the Service programs will be posted on the Seller’s website. The Buyer declares and guarantees that such a change of any information does not violate his interests, the Buyer does not and will not make any claims about it in the future.
4. Service program price and payment procedure
4.1. The price of the service program depends on the chosen program: MAXI, MIDI, MINI, which is chosen and ordered by the Buyer.
4.2. The price of the Service Program indicated at the time of placing the order by the Buyer is the final payment price, which includes all costs and fees for the selected Service Program.
4.3. When ordering the Service program, the buyer pays for it by the most popular payment methods – online banking (banklink), bank transfer or payment card. When paying for the Service program with a payment card, the payment card data is entered on the Seller’s website (card number, user name, card expiration date, card CVC2 code), payment is made with the payment card for the entire period of validity of the Service program or in periodic monthly payments (the Seller uses OPAY payment acceptance system).
4.4. If the buyer chooses to pay for the Service program in periodic payments, every month for the entire validity period, payment is possible only by payment card. The monthly price will be automatically debited from the Buyer’s payment card, the data of which is saved on the day of placing the order for the Service Program, every 30 days from the first payment for the Service Program. The first payment is made on the day of the order.
4.5. The Buyer, by ordering the Service program and checking “I have read and agree to the Rules and Privacy Policy” and clicking the “pay” button, confirms that he agrees with the payment method specified in clauses 4.3 and 4.4 of these Rules and chosen by the Buyer.
4.6. When ordering the Service program, the Buyer undertakes to have the amount of the Service program price in his payment card account during the entire settlement period, which will be automatically debited from the Buyer’s payment card, the data of which the Buyer provided to the Seller on the day of ordering the Service program.
5. Procedure for purchasing the service program
5.1. The Buyer, who has created a basket of goods remotely on the Seller’s website and marked “I have read and agree to the Rules and Privacy Policy”, after pressing the “pay” button, confirms that he has familiarized himself with these Rules and the Seller’s Privacy Policy, agrees with them and undertakes to comply with them.
5.2. The contract is concluded remotely and enters into force when the Buyer, after clicking the “pay” button in the order box, confirms that he agrees to purchase the Service program and agrees to the price of the Service program and the terms of its provision.
5.3. If, when purchasing the Service program remotely, the Buyer does not agree with these Rules, or any part of these Rules, the Privacy Policy, the price of the Service program or its part, the terms and conditions of the Service program, in this case the Buyer must not place an order, order the Service program, and not remotely Purchase – sale contract with the Seller.
5.4. The name of the service program, individual services included in the service program, their quantity are specified on the Seller’s website www.greitojizirafa.lt.
6. Procedure for using service programs
6.1. The Buyer, who has purchased the Service program from the Seller, uses the services of the purchased Service program during its validity period, which are provided to the Buyer at the veterinary clinic at the address Žemynos str. 2b, Vilnius.
6.2. The services specified in the Service program purchased by the Buyer are provided exclusively for one pet of the Buyer, which is registered in the Seller’s database during the initial visit to the veterinary clinic.
7. Processing of personal data
7.1. The Seller processes the Buyer’s personal data in accordance with the Privacy Policy, with which the Buyer is familiar and has given his consent to the processing of personal data.
8. Buyer’s rights and obligations
8.1. The Buyer must provide the Seller with correct identifying information when ordering the Service Program.
8.2. By agreeing to these Rules, the Buyer confirms that he is:
8.2.1. An active adult, that is, a natural person 18 (eighteen) years of age or older;
8.2.2. An able-bodied minor who is at least 16 years old and has the consent of his parents or other legal representatives;
8.2.3. A legal entity properly represented by a representative of a legal entity with the right to enter into transactions on behalf of a legal entity.
8.3. By agreeing to these Rules, the Buyer confirms that he does not violate the rights and legitimate interests of third parties when concluding a distance contract.
8.4. A person who does not comply with these Rules 8.2. of the criteria provided for in point 1, must not submit an order for the purchase of the Service program and not conclude a contract with the Seller, otherwise all the risk of negative consequences and legal responsibility related to this rests with such a person.
8.5. The buyer undertakes to pay the agreed price for the selected Service program in one payment for the entire period of validity of the Service program or in periodic payments during the period of validity of the Service program every month.
8.6. By ordering the Service program, the Buyer agrees that the Seller’s notifications related to the execution of the contract between the parties will be sent to the e-mail provided to the Seller.
- Seller’s rights and obligations
9.1. The Seller undertakes to provide the Buyer with services according to the Service program chosen by him during the entire period of validity of the purchased service.
9.2. The Seller undertakes to ensure the confidentiality of the information transferred to him by the Buyer and not to pass it on to third parties without the Buyer’s consent, except for the cases provided for by legal acts.
9.3. The seller has the right to unilaterally change these Rules by publishing their new version on the website www.greitojizirafa.lt. The changes come into force after the moment of publication for all concluded and concluded transactions.
10. Validity period of the service program
10.1. The Service Program is valid for one year from the date of order submission and confirmation and shall terminate automatically upon expiration.
10.2. The Service Program Agreement may be terminated by agreement of both parties.
10.3. The service program agreement can be terminated at the initiative of one of the parties by notifying the other party in writing 14 working days before the date of termination of this agreement.
10.4. When the Service program is terminated at the Buyer’s initiative, the Buyer undertakes to pay the Seller for all services actually received by the Buyer, their price calculated without the discounts for services provided for in these Rules and/or on the Seller’s website, applicable when they are ordered when purchasing the relevant Service program, i.e. in accordance with the currently valid prices of services at the veterinary clinic.
10.5. The price of the actually provided services to be paid by the Buyer cannot be lower than the amount that the Buyer has paid/has to pay to the Seller for using the services during the period of validity of the Service program until the day of its termination.
11. Final Provisions
11.1. These Rules are governed by the law of the Republic of Lithuania.
11.2. The distribution of any e-store information (text, files, photos, images) without the written consent of the Seller is prohibited.
11.3. All disagreements arising from the implementation of these Rules are resolved through negotiations. If it is not possible to reach an agreement, disagreements are resolved according to the procedure established by the laws of the Republic of Lithuania.
11.4. The seller has the right to unilaterally change these Rules by publishing their new version on the website www.greitojizirafa.lt. The changes come into force after the moment of publication for all concluded and concluded transactions.
